Terms & Conditions
These terms apply to every booking made with Gig Harbor Party Bus & Limo Service, whether by phone, email or online. They cover airport and cruise transfers, hourly limousine and party bus hire, weddings, school events, corporate accounts and everything else we run. Please read section 11 on alcohol and section 14 on damage before booking a group vehicle.
01Agreement and definitions
These Terms and Conditions form the agreement between you and {{LEGAL_ENTITY}}, trading as Gig Harbor Party Bus & Limo Service, for the provision of chauffeured ground transportation. Making a reservation, paying a deposit or travelling in one of our vehicles means you accept these terms on behalf of yourself and every member of your party.
In this document, we, us and the Company mean Gig Harbor Party Bus & Limo Service. You and the Client mean the person or organisation who makes and holds the reservation. Passenger means any person travelling in the vehicle. Booking Contact means the individual named on the reservation, who is responsible for the booking and is the only person authorised to change it.
A Transfer is a point-to-point journey, such as an airport or cruise pier run, priced as a single fare. An Hourly Booking or Charter is any booking where the vehicle and chauffeur remain with your party, priced by the hour against a minimum, such as a wedding, prom, tasting tour or night out.
02Reservations and confirmation
A reservation is not confirmed until we have issued a written confirmation by email or text and, where one is required, received the deposit. A verbal enquiry, an online quote or an unanswered request does not reserve a vehicle or a date.
You are responsible for the accuracy of the information you give us, including pickup and drop-off addresses, passenger numbers, luggage counts, flight numbers, contact telephone numbers and the times you require. We plan vehicles, chauffeurs and routes on that information, and we are not liable for delay, additional charges or a failed pickup arising from details supplied incorrectly or incompletely.
Where a booking involves an address on a private lane, shared drive, gravel road or anywhere a long vehicle needs room to turn, tell us at the time of booking. We will confirm access in advance where we can. If a vehicle cannot safely reach a location that was not disclosed, we will collect from the nearest safe point and the booking will be treated as fulfilled.
03Rates and what they include
Transfers are quoted point to point and are not subject to an hourly minimum. Hourly bookings are quoted at the applicable hourly rate against a minimum booking period, which varies by vehicle class and is stated on your quote. Current published rates run from $100 per hour for a premium sedan with a two-hour minimum to $300 to $350 per hour for a party bus with a five-hour minimum.
Unless your quote says otherwise, the quoted price includes the chauffeur, fuel, all applicable taxes and surcharges, road tolls including the Tacoma Narrows Bridge, and standard luggage assistance. It does not include gratuity, parking or venue access charges levied by a third party, or any optional add-on.
Optional add-ons are charged as published at the time of booking and itemised on your quote. These currently include meet and greet inside the terminal at $50, infant and toddler seats at $25 each, booster seats at $20, pet travel in a carrier at $30 and additional stops on route at $25. Child seat charges apply in each direction on a round trip.
Higher rates and longer minimum booking periods apply on peak dates. Peak dates include Friday and Saturday evenings, the prom season in April and May, the month of December, New Year's Eve, public holiday weekends and major regional event weekends. Peak pricing is applied to your quote before you book and is never applied afterwards. We do not use demand-based or surge pricing. The rate stated on your confirmation is the rate you will be invoiced.
04Deposits, payment and gratuity
A deposit of {{DEPOSIT_TERMS}} is required to secure a date and vehicle on hourly bookings and on any booking made more than {{BALANCE_DUE}} in advance. The deposit is applied against the final balance. The balance is due {{BALANCE_DUE}}.
We accept {{PAYMENT_METHODS}}. The Booking Contact is responsible for the full amount due, including any additional charges properly incurred under these terms, regardless of any arrangement between members of your party to share the cost. We do not split a booking across multiple payers.
By providing card details you authorise us to charge that card for the agreed fare, for any overtime or add-on incurred on the day, and for any damage, cleaning or sanitation charge assessed under section 14. Where a charge is assessed after the journey, we will notify the Booking Contact in writing with an explanation before the card is charged.
Gratuity is not included in the quoted fare and is entirely at your discretion. Fifteen to twenty percent of the fare is customary in this industry. Gratuity can be added to your booking in advance on request, so that nothing needs to be settled at the kerb.
Corporate accounts may be invoiced monthly with itemised trip detail, and purchase order, department or project references can be carried to the invoice line. Net payment terms are available on established accounts by prior agreement.
05Cancellations and changes
Transfers. Airport, cruise and other point-to-point transfers may be cancelled without charge up to 24 hours before the scheduled pickup time. Cancellations inside 24 hours may be charged in full at our discretion, taking into account the vehicle class and the date.
Hourly bookings. Weddings, proms, tasting tours, nights out and other hourly bookings may be cancelled without charge up to {{CANCEL_EVENT}} before the scheduled start. Inside that window the deposit is non-refundable, and cancellations inside {{CANCEL_PEAK}} may be charged in full.
Peak dates. Bookings on peak dates as defined in section 3 may carry different cancellation terms, which will be stated on your quote before you pay a deposit.
Flight cancellations. If your flight is cancelled by the airline, contact dispatch as soon as you are able. We will rebook or release the reservation without a cancellation charge. This does not apply to a decision not to travel.
Changes. Changes to date, time, vehicle class, passenger numbers or itinerary are subject to availability and may change the price. Only the Booking Contact may authorise a change. We will confirm any change in writing; a change discussed verbally and not confirmed in writing has not been made.
Reducing the booked hours on an hourly booking after the minimum has been agreed does not reduce the charge below the applicable minimum.
06Wait time, overtime and no-shows
Complimentary wait time. Airport arrivals include 30 minutes of complimentary wait time from the actual time of landing. All other pickups include 15 minutes of complimentary wait time from the scheduled pickup time. Wait time beyond the complimentary period is charged at the applicable hourly rate in 30-minute increments.
Overtime. Where an hourly booking runs beyond the booked period, the additional time is charged at your quoted hourly rate in 30-minute increments. The chauffeur will make the Booking Contact aware before the booked period ends wherever it is practical to do so. Continued availability of the vehicle beyond the booked period is not guaranteed, as vehicles are frequently scheduled for a subsequent booking.
No-shows. If no passenger presents at the agreed pickup point within the complimentary wait period and we are unable to make contact on the telephone numbers supplied, the booking may be recorded as a no-show and charged in full. Please contact the chauffeur or dispatch rather than leaving the pickup point.
07Airport and cruise pickups
Where you supply a flight number, we track the inbound flight from departure at the origin airport and adjust the pickup accordingly at no additional charge, whether the flight is early or delayed. If you do not supply a flight number we schedule to the time you give us and the complimentary wait period applies from that time.
Standard airport collection is kerbside on the arrivals level. You will be sent the door and island number by text. Meet and greet inside the terminal at baggage claim, with a name board, is available as an add-on and must be requested at the time of booking.
You are responsible for clearing the terminal within a reasonable time and for contacting the chauffeur or dispatch if you are delayed inside the airport. Airport authorities restrict standing at kerbside, and a chauffeur may be required to circulate; this does not constitute a failure to provide the service.
For cruise sailings, we schedule against your assigned boarding window and, on return, against the vessel's actual arrival rather than its published time. Cruise lines and port authorities control access to the piers and we cannot guarantee a particular drop-off point within a terminal.
08Itineraries, routes and stops
For hourly bookings, the itinerary agreed in writing before the date is the itinerary the chauffeur will drive. Additional stops requested on the day may be accommodated where they are safe, lawful and fit within the booked hours, and may incur an additional stop charge or overtime.
The chauffeur has sole discretion over the route taken, having regard to traffic, road conditions, roadworks, weather, vehicle dimensions and passenger safety. Requests to take a particular route will be accommodated where it is safe and practical to do so.
Chauffeurs will not drive a vehicle onto a surface, gradient or access road where in their reasonable judgement the vehicle may be damaged, grounded or unable to turn, nor into any location where doing so would breach a traffic regulation or a venue restriction.
09Passenger capacity
The seating capacity stated for each vehicle is a legal limit and not a guideline. The chauffeur cannot carry more passengers than the vehicle is licensed and equipped to seat, under any circumstance, and is not permitted to exercise discretion on this point.
If your party exceeds the booked capacity on the day, the excess passengers cannot travel. Please advise us as soon as your numbers change so that we can move you to a larger vehicle class or add a second vehicle, subject to availability and to any difference in price.
Passenger capacity and luggage capacity are separate figures. Stretch limousines and party buses carry passengers well and luggage poorly. Where luggage capacity is material to your booking, tell us the number of checked bags and we will size the vehicle accordingly.
10Child restraints and minors
Washington State law requires an appropriate child restraint for children under eight years of age unless the child is 4 feet 9 inches or taller. Infant, toddler and booster seats are available as an add-on and must be requested at the time of booking, with the child's age and weight so that the correct seat is fitted. Charges apply in each direction on a round trip.
You may supply and fit your own child restraint. Where you do, you are responsible for its condition, suitability and correct installation.
Bookings carrying passengers under 21. Any reservation on which one or more passengers will be under 21 years of age must be made and held by a parent, guardian or other responsible adult aged 21 or over. That adult is the Booking Contact and is the only person who may agree or alter the itinerary. Passengers under 21 may not create, change, extend or cancel a reservation, and a chauffeur will not act on such a request.
For school events including proms and graduations, the agreed itinerary must include every pickup address, every intermediate stop, the venue and every drop-off address. The chauffeur will not take passengers to any address that does not appear on that itinerary. Requests to change the itinerary during the booking will be referred to the Booking Contact by telephone and will only be actioned with that person's express agreement.
Unaccompanied minors under 16 years of age are not carried without prior written arrangement.
11Alcohol
Alcohol may be consumed by passengers of legal drinking age in our stretch limousines and party buses, subject to Washington State law and to this section. There is no consumption of alcohol and no open container permitted in our sedans or SUVs, which are not equipped or licensed for it.
Every passenger on a booking where alcohol will be carried or consumed must be 21 years of age or older. The chauffeur may require proof of age from any passenger and may refuse to permit consumption where satisfactory proof is not produced.
Where any passenger is under 21, no alcohol may be carried or consumed in the vehicle by anyone, including passengers who are over 21. There is no exception to this, including where a parent or guardian consents. Alcohol found on such a booking will be removed from the vehicle, and section 20 may be applied.
You are responsible for supplying your own alcohol; we do not sell, supply or serve it. Glassware, ice and coolers can be prepared in advance on request. You are responsible for the conduct of your party and for any consequence of consumption within the vehicle.
The chauffeur may at any time require that alcohol be put away, may decline to permit further consumption, and may decline to carry or continue to carry any passenger who in their reasonable judgement is intoxicated to a degree that presents a risk to themselves, to other passengers, to the chauffeur or to the vehicle.
12Cannabis, smoking and vaping
Cannabis may not be consumed in any of our vehicles by any passenger of any age. Consumption of cannabis in a motor vehicle is unlawful in Washington State irrespective of who is driving, and it places our operating authority at risk. This applies to smoking, vaping and edibles.
Smoking and vaping of any substance, including tobacco and nicotine products, is prohibited in all vehicles at all times.
A breach of this section will result in the journey being ended under section 20 and the application of the sanitation charge described in section 14, and no refund will be due.
13Conduct and safety
The Booking Contact is responsible for the conduct of every member of the party for the duration of the booking.
Passengers must comply with all reasonable instructions given by the chauffeur relating to safety and to the operation of the vehicle. Passengers must remain seated while the vehicle is in motion where the vehicle is fitted with seating for that purpose, must not obstruct the chauffeur or interfere with any control, must not open a door while the vehicle is moving, and must not put any part of the body or any object outside the vehicle.
The following are prohibited at all times: unlawful substances of any kind; weapons other than as lawfully carried by a person permitted to do so; the throwing of any item from or within the vehicle; standing through a sunroof or roof hatch; and any behaviour that is threatening, abusive or discriminatory toward the chauffeur, another passenger or a member of the public.
Our chauffeurs are entitled to work free from abuse. Behaviour of that kind will end the booking immediately under section 20.
14Damage, cleaning and loss
The Booking Contact is responsible for the cost of repairing or making good any damage to the vehicle, its interior, its fittings or its equipment caused by any member of the party, whether deliberate or accidental, beyond fair wear and tear. This includes but is not limited to burns, tears, breakages, stains, damage to upholstery, glassware, sound or lighting equipment, and damage arising from items brought into the vehicle.
A cleaning charge of {{CLEANING_FEE}} applies where the vehicle requires cleaning beyond the normal valet between bookings. A sanitation charge of {{BIOHAZARD_FEE}} applies where bodily fluids require specialist cleaning and the vehicle must be withdrawn from service.
Where damage takes a vehicle out of service, you may additionally be liable for the loss of revenue from bookings that we are unable to fulfil, up to the value of the bookings actually cancelled as a direct result.
Any charge under this section will be assessed after the booking and notified to the Booking Contact in writing, with photographs and, where repair is involved, a copy of the invoice or estimate, before any card is charged. We do not apply a blanket charge and we do not charge for ordinary use of the vehicle.
15Decorations and equipment
Ribbons, magnetic signs and a floral arrangement placed on the rear parcel shelf are permitted. Anything adhesive, anything that marks or scratches paintwork or glass, and anything attached to the vehicle by a fixing are not.
Confetti, rice, birdseed, glitter, silly string, party poppers and similar are not permitted in or on any vehicle. Where these are used, the cleaning charge in section 14 will apply.
Where you wish to decorate a vehicle, tell us in advance and bring the decoration with you; the chauffeur will fit what is permitted before the first pickup. Decorations are fitted at your risk and we accept no responsibility for their condition or retention during the journey.
Vehicles are supplied with the equipment described at the time of booking. Sound, lighting and climate systems in party buses and limousines are provided for enjoyment but are not the subject of the contract, and a fault in an entertainment system during a booking does not entitle you to a refund of the fare.
16Luggage and personal property
Luggage capacity varies substantially by vehicle class and is stated for each vehicle. You are responsible for advising us of the number and nature of items to be carried at the time of booking. We are not obliged to carry items that exceed the stated capacity of the vehicle booked, or that in the chauffeur's reasonable judgement cannot be carried safely.
Chauffeurs provide assistance with loading and unloading luggage as a courtesy. Passengers remain responsible for their own property at all times, including checking that nothing has been left in the vehicle at the end of the journey.
We do not accept liability for loss of or damage to luggage or personal property except where caused by our negligence. Items of exceptional value, including cash, jewellery, electronic equipment, medication, travel documents and business materials, should be kept with you and should not be placed in the luggage compartment.
Property found in a vehicle is logged and held for {{LOSTPROP_DAYS}}. Contact dispatch to arrange collection or return; return by carrier is at your cost. Unclaimed property is disposed of after that period.
17Pets and service animals
Trained service animals accompanying a person with a disability are carried at no additional charge in all vehicles, in accordance with applicable law. Please tell us in advance so that we can allocate an appropriate vehicle.
Other animals are carried only when arranged in advance and only where the animal is contained in a suitable closed carrier for the duration of the journey. A charge applies. The Booking Contact is responsible for any cleaning or damage charge arising under section 14.
18Vehicle allocation and substitution
We reserve a vehicle class rather than a specific vehicle. Images on our website are representative of the class and specific vehicles within a class may differ in colour, trim, model year and detail.
Where a mechanical fault, accident, act of a third party or other circumstance prevents us from supplying the booked vehicle, we will supply a vehicle of equivalent or greater capacity where one is available. Where only a smaller vehicle or more than one vehicle is available, we will contact you to agree how to proceed and will adjust the charge accordingly.
Where we are unable to supply any suitable vehicle, our liability is limited to a full refund of amounts paid for that booking, in accordance with section 21.
Our fleet is owned and maintained by us and driven by our own chauffeurs. Where exceptional demand requires it, we may arrange for a booking to be fulfilled by another licensed and insured operator; we will tell you if that is the case before the date.
19Delays and events beyond our control
We build buffer time into every schedule and check traffic conditions on the day, but we cannot guarantee a journey time. We are not liable for any loss arising from delay caused by traffic congestion, collisions, roadworks, bridge or ferry closures or restrictions, weather, act of government or public authority, industrial action, civil disruption, or any other cause beyond our reasonable control.
In particular, and without limiting the above, our routes depend on infrastructure we do not control, including the Tacoma Narrows Bridge, the SR-3 and SR-16 junction at Gorst, the Fox Island Bridge, the Agate Pass Bridge and the Washington State Ferries and Kitsap Transit sailing schedules. Advice we give about sailing times, tolls and typical journey durations is offered in good faith and is not a warranty.
Where you have a fixed commitment such as a flight, a sailing or a ceremony, please book a pickup time that carries an appropriate margin. We will advise a recommended pickup time on request and will always recommend the more conservative option.
20Refusal and termination of service
We may decline to begin, or may end, a booking at any point where in the reasonable judgement of the chauffeur or of dispatch:
- a passenger is intoxicated or under the influence of a substance to a degree that presents a risk;
- a passenger behaves in a manner that is unsafe, unlawful, threatening, abusive or discriminatory;
- section 11, 12 or 13 is breached;
- the number of passengers exceeds the licensed capacity of the vehicle;
- a passenger requires medical attention;
- continuing would place the chauffeur, the passengers, the vehicle or our operating authority at risk.
Where a booking is ended under this section, the vehicle will be brought to a safe stopping place. On a booking carrying passengers under 21, the chauffeur will contact the Booking Contact and will either return the party to the agreed drop-off addresses or wait with the party until a responsible adult attends, as the Booking Contact directs. No refund is due where a booking is ended under this section, and any charge under section 14 remains payable.
21Insurance and limitation of liability
We hold commercial automobile liability and general liability insurance as required for our operating authority in Washington State. A certificate of insurance is available on request, and your organisation can be named as certificate holder, or as additional insured where a contract requires it and we agree in advance.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above, our total liability arising out of or in connection with a booking, whether in contract, tort, negligence, breach of statutory duty or otherwise, is limited to the amount paid by you for that booking.
Subject to the paragraph above, we are not liable for indirect or consequential loss, including missed flights, missed sailings, missed connections, missed events, loss of earnings, loss of enjoyment, accommodation or rebooking costs, or any other loss that does not arise directly from our provision of the transportation itself.
22Licensing and compliance
We operate under the licences and permits required in Washington State for the classes of vehicle we run, including {{UTC_PERMIT}}, and we maintain the vehicle inspection and maintenance regime those require.
Every chauffeur holds the appropriate commercial licence and endorsements for the vehicle they drive, and is background-checked and subject to our drug and alcohol testing policy. Chauffeur details can be supplied in advance where a client's site or security arrangements require it.
We comply with applicable hours-of-service requirements. Where a booking would require a chauffeur to exceed permitted driving hours, we will allocate a relief chauffeur or advise you that the itinerary must be adjusted.
23Privacy and recordings
We collect and process the personal information necessary to provide the service you have booked, including names, contact details, addresses, itineraries and flight numbers. We do not sell personal information. Our handling of personal information is described in our Privacy Policy, which forms part of these terms.
Some vehicles are fitted with forward-facing and interior cameras for the safety of passengers and chauffeurs and for the investigation of incidents and damage claims. Where interior recording is in operation it is signed within the vehicle. Recordings are retained only as long as necessary for those purposes and are not used for any other purpose.
Where a booking is made on behalf of another person, you confirm that you are authorised to provide us with that person's information for this purpose.
24Complaints, governing law and changes
If something goes wrong, tell us as soon as you can, and while the booking is running if that is possible, so that we have the opportunity to put it right at the time. Formal notices to the Company should be sent to {{NOTICE_ADDRESS}}.
These terms are governed by the laws of the State of Washington. The parties submit to the exclusive jurisdiction of the state and federal courts located in Pierce County, Washington.
If any provision of these terms is found to be unenforceable, that provision will be severed and the remainder will continue in full force.
We may amend these terms from time to time. The version in force at the time your booking is confirmed is the version that applies to that booking. The current version is always published at this address with its effective date.
